Vehicle Auction Rules
All lots are sold AS IS, WHERE IS, with no warranty and no refunds.
Please understand that we are auctioning donated items and the condition is as you see it. If you win the bid, you understand that you are purchasing the lot with no specific or implied warranty on the condition of the item. We do our best to identify mechanical issues without driving these vehicles off our lot; there is no way for us to identify transmission or internal engine problems. We do not disclose any damages of a cosmetic nature.
Due to restrictions placed on us by the Texas Department of Motor Vehicles, we are no longer able to provide temporary plates. It is the customer’s responsibility to obtain their own 30-day temporary plate from the tax office after purchase.
Auction Rules
- A $200.00 minimum refundable deposit is due upon registration.
- You must be at least 18 years old to participate in the auction.
- If you do not win a bid, your deposit will not be captured. The authorization will expire according to your bank’s policy.
- Please have your valid picture ID at the time of payment. Buyers taking vehicles out of state or out of the country must have a valid ID from that state or country.
- You must pay in full, in person, for all purchases — Saturday: 10:00 AM – 3:00 PM; Monday: 8:00 AM – 4:00 PM.
- If your vehicle has not been paid for by 12:00 PM (CST) on Wednesday, the bidder will be banned from future auctions, the vehicle will be returned to inventory, and the bidder will forfeit their deposit. A $500.00 deposit will be required the next time the bidder registers after being banned for non-payment.
- Your online bid is an agreement to purchase. If you purchase multiple vehicles, you are responsible for payment of all vehicles.
- If you do not have funds available to pay for all vehicles purchased, do not bid.
- You may view the vehicles on Fridays from 8:00 AM – 5:00 PM.
- If an individual wins a bid that has been marked as Dealer Only, the bidder will forfeit their $200 deposit. Please review each vehicle carefully to ensure you are not bidding on vehicles you cannot purchase.
Additional Fees
The following fees may apply to your purchase:
- Purchase Price
- Buyer’s Premium ($300 + 10% of sales price)
- Processing Fee — Dealers: $80.00; Individuals: $80.00
- State Sales Tax (6.25%) — paid to the County Tax Office
- Vehicle Inventory Tax (0.001856 × sales price) — paid to the County Tax Office
- Title Application Fee ($33.00) — paid to the County Tax Office
- $50.00 Transfer Fee (if transferring into a different bidder’s name after the bid is won)
- $50.00 per day, per lot storage fee if not removed by 4:00 PM (CST) Monday
The buyer is responsible for obtaining a 30-Day Temporary Plate, vehicle inspection, and registration after purchase.
After the Auction
- All vehicles must be picked up by 4:00 PM (CST) the Monday following the auction.
- After 4:00 PM Monday, a $50.00 per vehicle, per day storage fee will apply until 12:00 PM (CST) Wednesday. No exceptions.
- A stamped paid receipt and vehicle keys (if available) must be shown to security before removing your vehicle.
- You will not be allowed into the auction area until the auction is over.
- Please do not climb or sit on vehicles, motorcycles, boats, or any auction item.
- Do not lift the hood or open doors to any vehicle you have not purchased.
- Every Car Can reserves the right to pass on any item at any time during the auction.
- Children must remain with a parent or guardian at all times. Please do not allow children to get inside vehicles or climb on auction items.
Terms and Conditions
Tax, title, e-tag, Vehicle Inventory Tax (VIT), and license fees will be collected on vehicles sold unless current dealer documentation is on file. Dealers must register their dealership and any authorized users before participating.
At the time of sale, the Auctioneer announces the buyer’s number and the final price of each item. A verbal contract is considered binding, and payment is expected immediately. The Auctioneer reserves the right to settle any disputes regarding price, quantity, tie bids, or bidder identity. All decisions of the Auctioneer are final.
Each lot is sold AS IS, WHERE IS, with no warranty or guarantee expressed or implied. Buyers are responsible for inspecting vehicles before bidding. Every Car Can makes no warranties regarding transmission, engine, mechanical condition, or cosmetic appearance.
Merchandise may be removed only after payment has been completed and accompanied by a paid receipt. Merchandise not removed by 4:00 PM the Monday following the sale will incur a $50.00 per lot, per day storage fee.
Vehicle titles are transferred between the seller and buyer. Loss or lack of title is not the responsibility of the Auctioneer.
Announcements made by the Auctioneer during the auction supersede all printed or verbal material.
Every Car Can is not responsible for:
- Accidents
- Personal injury
- Property damage
- Lost or stolen merchandise
- Lost keys
- Lost titles
Sales are subject to Texas sales tax unless valid resale documentation is provided before payment. All purchases become the responsibility of the buyer immediately upon purchase.
Failure to complete the purchase process after winning an auction will result in forfeiture of the bidder’s deposit.
